These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users, students, and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.
You represent that you are over the age of 16. For participants under 18, parental or guardian consent is required for enrollment in training programs.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Website and tells You about Your privacy rights and how the law protects You. Use of Our Service
Account Registration
When you create an account with us or enroll in a training program, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account or enrollment.
User Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Attending scheduled classes and completing course requirements
- Respecting other students and instructors
- Following the code of conduct during training sessions
Training Programs and Enrollment
Course Enrollment
- Enrollment is subject to availability and eligibility requirements
- Some programs may require prerequisite qualifications or assessments
- We reserve the right to accept or decline enrollment applications
- Course schedules, formats, and instructors may be subject to change
Professional Qualification Programs
For our OFPPT-certified Professional Qualification programs:
- Programs are free of charge for eligible French citizens
- Participants must meet OFPPT eligibility criteria
- Attendance requirements must be met to maintain enrollment
- Certification is awarded upon successful completion of all requirements
- Monthly stipend (if applicable) is subject to OFPPT regulations
Language Training Programs
- Course fees must be paid according to the payment schedule
- Materials and textbooks may be provided or required separately
- Progress assessments will be conducted regularly
- Certificates are issued upon successful course completion
Corporate Training
- Custom programs are subject to separate agreements
- Pricing and schedules are negotiated on a case-by-case basis
- Minimum participant numbers may apply
Payment Terms
Course Fees
- All fees are displayed in Euros (EUR)
- Payment must be received before course commencement unless otherwise agreed
- Payment methods accepted: [bank transfer, cash, credit card, etc.]
- Receipts will be provided for all payments
Payment Plans
- Installment plans may be available for certain courses
- Late payment fees may apply for overdue installments
- Access to classes may be suspended for non-payment
Refund Policy
Professional Qualification Programs (Free): No refunds applicable
Paid Language/Professional Courses:
- Full refund if cancelled by student 7 days before course start
- 50% refund if cancelled 3-7 days before course start
- No refund for cancellations less than 3 days before start
- No refund after course commencement
- Refunds processed within 14 business days
Exceptions: No refunds for absences, voluntary withdrawal after commencement, or disciplinary dismissal
Intellectual Property
Our Content
The Service and its original content, features, and functionality are and will remain the exclusive property of EDUMOTIV and its licensors. The Service is protected by copyright, trademark, and other laws.
Training Materials
- All course materials, presentations, handouts, and digital content are proprietary
- Materials are provided for personal educational use only
- Reproduction, distribution, or commercial use is prohibited without written consent
- Recording of classes requires instructor permission
Your Content
By submitting assignments, projects, or other work, you grant us a license to use, reproduce, and display such content for educational and promotional purposes.
Code of Conduct
Students and participants agree to:
- Attend classes punctually and regularly
- Respect instructors and fellow students
- Refrain from disruptive behavior
- Not engage in cheating, plagiarism, or academic dishonesty
- Follow health and safety guidelines at our facilities
- Not record or photograph without permission
Violation of the code of conduct may result in:
- Warning
- Temporary suspension
- Permanent expulsion without refund
- Legal action if applicable
Attendance and Completion
Attendance Requirements
- Minimum attendance rates apply (typically 80% for certification programs)
- Absences must be reported and may require documentation
- Excessive absences may result in program dismissal
Certification
- Certificates issued upon successful completion of all requirements
- Requirements may include: attendance, assessments, projects, exams
- Certificates are provided in digital and/or physical format
- Replacement certificates may incur a fee
Service Modifications and Cancellations
By EDUMOTIV
We reserve the right to:
- Modify course content, schedules, or instructors
- Cancel courses due to insufficient enrollment (with full refund)
- Suspend services for maintenance or technical issues
- Update these Terms with reasonable notice
Course Cancellations by Us
If we cancel a course:
- Full refund of paid fees
- Option to transfer to alternative course
- Reasonable advance notice when possible
Limitation of Liability
To the maximum extent permitted by French law:
- EDUMOTIV is not liable for failure to obtain employment, certifications, or specific outcomes
- We are not responsible for personal injuries on premises except where caused by our negligence
- Our total liability shall not exceed the amount paid by you for the specific service
- We are not liable for indirect, consequential, or incidental damages
We do guarantee:
- Quality instruction by qualified professionals
- Proper facilities and learning environment
- Adherence to OFPPT standards for accredited programs
Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.
The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

Termination
By Us
We may terminate or suspend Your access immediately, without prior notice or liability, for any reason including:

- Fraudulent enrollment information
- Disruptive or inappropriate behavior
- Non-payment of fees
- Violation of code of conduct
By You
You may terminate your enrollment by:
- Providing written notice to administration
- Understanding that refund policy applies
- Returning any borrowed materials or equipment
Upon termination, Your right to use the Service and attend classes will cease immediately.
“AS IS” and “AS AVAILABLE” Disclaimer
The Service is provided to You “AS IS” and “AS AVAILABLE” with all faults and defects without warranty of any kind.
To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service.
However, we commit to:
- Providing quality education by qualified instructors
- Maintaining proper facilities and equipment
- Following OFPPT standards for accredited programs
- Supporting students throughout their learning journey
Governing Law
The laws of France, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.
Disputes Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company through:

Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Translation Interpretation
These Terms and Conditions may be available in French or Arabic. You agree that the original English text shall prevail in the case of a dispute or interpretation discrepancy.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect.
